Masimo, which sought $3.1 billion in patent infringement damages, was also found guilty by the International Trade Commission. In October, the order requiring action against Apple entered the 60-day Presidential approval process. The confirmation process is expected to end on December 25, but Biden has yet to rule out the decision. Apple also had to take action on this.
Apple Stores will remove the Apple Watch 9 and Apple Watch Ultra 2 from their shelves starting December 21. Apple-approved retail outlets will be sold out from December 24. Apple Watches have offered blood oxygen measurement features since 2020, but the patents Masimo is suing for are only available on the Apple Watch 9 and Apple Watch Ultra 2 models. Apple will appeal the decision after the president's approval and await the outcome
